Contractors & Subcontractors

Get Paid. Defend Your Work. Protect Your Business.

Common Issues

  • Nonpayment for labor, materials, or change orders
  • Improper backcharges or withholding
  • Mechanics’ lien enforcement
  • Delay claims and “no damages for delay” clauses
  • Wrongful termination or interference
  • Defense against defect or code violation allegations

Mechanics’ Liens: Secure Your Payment

Minnesota lien laws are strict. To protect your lien rights:

  • Contractors must serve a pre-lien notice within 10 days
  • Subcontractors/suppliers must serve notice within 45 days of first work
  • Liens must be filed and served within 120 days of last work
  • Foreclosure must begin within 1 year or the lien expires

We draft and record lien claims, serve owners, and file lawsuits when necessary.

When Owners Don't Pay

We file breach of contract lawsuits to recover:

  • Outstanding invoices
  • Retainage and change orders
  • Delay damages
  • Attorney’s fees (where allowed by contract or law)
  • Interest and penalties under prompt payment statutes

We Also Defend Contractors

If you're accused of defective work, we can defend you. These cases often involve:

  • Alleged water damage, HVAC or plumbing problems
  • Mold or building code violations
  • Faulty installation claims by homeowners or developers
  • Fault shifting by upstream contractors or architects

We help document compliance, engage experts, and challenge improper claims.

Indemnity & Risk Allocation

Minnesota law limits indemnity provisions that shift liability for another’s negligence. But courts enforce agreements that require you to carry insurance for someone else’s benefit.

We review your contracts for:

  • Enforceability under Minn. Stat. § 337.02 and § 337.05
  • Exposure to indemnity or contribution claims
  • Traps hidden in boilerplate or bid terms

Our Advantage: Construction Focused Litigation

We understand how construction works on-site and on paper. We work with engineers and tradespeople to present a clear defense or payment claim. We know how to avoid common litigation pitfalls and recover what you're owed.
